Terms and Conditions

Last updated: 4 September 2026. These terms summarise how our puppies are placed. They apply to enquiries, reservations and purchases from the Joiel’s Palace kennel and to the use of this website.

Scope and precedence

In an individual case the signed contracts are always binding: the reservation contract, where a reservation has been agreed, and the sales contract for the purchase. These terms explain their content and do not replace it. Where a signed contract differs from these terms, the contract prevails.

Information on this website

Information about planned litters, mating dates, litter sizes and handover dates states our intention and is not a binding offer. Whether and when a litter arrives depends on nature. No claim to a puppy arises from an announcement.

Enquiry and allocation

An enquiry through the form or by e-mail is non-binding. We select and allocate the puppies ourselves. There is no claim to a particular puppy.

Unless expressly agreed in writing, there is no claim to a particular sex, colour or other specific characteristics.

We reserve the right to decline a sale or to withdraw from it where there is reasonable doubt that species-appropriate keeping, responsible care or the wellbeing of the puppy is assured at the intended home.

Reservation and reservation fee

As a rule we do not work with reservations: an enquiry is followed by allocation and then by the sales contract. In special cases a reservation may be agreed. Where one is agreed, the following applies.

A reservation becomes binding with the signed reservation contract and payment of the reservation fee. The fee amounts to approximately 15 % of the purchase price and must be transferred to the account stated within the period set out in the contract. The reservation is binding only once payment has been received in full.

The reservation fee is credited in full against the purchase price when the sales contract is concluded. It is not a part payment under the sales contract but secures the reservation; the sales contract comes into existence only upon its separate signature.

If the buyer withdraws from the reservation without a reason provided for in the contract, the reservation fee is forfeited to the kennel as compensation for the effort incurred and the lost placement opportunity.

If we cannot offer a suitable puppy, if the litter does not materialise, or if we cancel the sale for reasons within our responsibility, the reservation fee is refunded in full, or on request credited against a later litter.

Price and payment

The purchase price is set out in the sales contract and is payable on collection of the dog. Any reservation fee already paid is credited against it.

In addition to the purchase price, deposits are lodged for the HD/ED X-ray and the ECVO eye test. These are refunded in full as soon as we receive the written reports. The amounts are stated in the sales contract.

Handover and documents

The dog is handed over in person at our home; we do not ship. On collection, ownership, benefit and risk pass to the buyer. The following are handed over free of charge:

Before leaving us, every puppy has been wormed twice and the basic immunisation against distemper, hepatitis, leptospirosis, parvovirosis and kennel cough has been started. Vaccinations still due are noted in the pet passport.

What we warrant

The examination results of the parent dogs for HD/ED, eyes and DNA can be viewed on this website and are documented in the pedigree.

Warranty

If significant defects appear after handover and up to the age of 15 months, which demonstrably existed before handover but were not apparent on careful examination, an appropriate amount may be reclaimed. A defect is significant if it considerably reduces the dog's life expectancy.

Such defects must be established by a vet without delay after discovery and reported to us in writing immediately, enclosing the veterinary findings.

Any further liability is excluded. Veterinary, care and other costs are not reimbursed. No breeder can guarantee that an animal will remain healthy for life.

Taking the dog back in special cases

In the event of an allergy, incompatibility with other animals living in the household or other unforeseeable circumstances, we will take the dog back within 20 days, after consultation, against repayment of the full purchase price.

Obligations after purchase

Passing the dog on and right of first refusal

The dog may not be passed to private or commercial dog dealers, nor for the purposes of animal experiments.

For every sale and every transfer free of charge, to whomever, the kennel holds a right of first refusal. We must be informed in good time and in writing of the terms and of the person taking the dog on, and we will declare within 14 days whether we exercise that right. The buy-back price payable by us is graduated according to the dog's age and specified in the sales contract.

If we do not exercise the right, it must be ensured that the new keeper likewise submits to this right of first refusal. If the dog is passed on in disregard of it, a contractual penalty of three times the purchase price falls due.

Breeding

If the dog is used for breeding, this is done exclusively with recognised papers from the FCI, AKC, CKC or KC. The same applies to use under a breeding-rights arrangement. Breeding without such papers incurs a contractual penalty of three times the purchase price, and the dog is barred from breeding.

Breach of duties of care

If the warranted duties regarding species-appropriate keeping and care are breached, we are entitled to take appropriate steps in the dog's interest: inspection, a report to animal welfare authorities, a contractual penalty or a report to the authorities.
